Thriveme Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the Thriveme platform (“Platform”), including our website, mobile applications, and any related services offered by Thriveme, a business based in New Delhi, India (“Thriveme”, “we”, “us”, or “our”).

1. Acceptance of Terms

By accessing or using the Platform, you agree to be bound by these Terms and all applicable laws and regulations. If you disagree with any part of these Terms, you may not access or use the Platform.

2. User Types and Responsibilities

• Clients: Clients are businesses or individuals who use the Platform to list their businesses with Thriveme. Clients are responsible for:
  • Providing accurate and up-to-date information about their business listing.
  • Complying with all applicable laws and regulations related to their business operations.
  • Responding promptly to inquiries from potential customers.
  • Maintaining a professional and respectful demeanour when interacting with users on the Platform.
• Listing Owners: Listing owners are authorized representatives of Clients who manage their business listings on the Platform. Listing owners are responsible for all activity associated with their listings. By submitting their listings they agree with our listing guidelines as mentioned here.
• Customers: Customers are users who search for and view business listings on the Platform. Customers are responsible for:
  • Using the Platform for lawful purposes only.
  • Not posting any false, misleading, or defamatory information.
  • Treating all businesses listed on the Platform with respect.
• Reviewers: Reviewers are users who submit reviews of businesses listed on the Platform. Reviewers are responsible for:
  • Posting reviews based on their own genuine experience with the business.
  • Writing reviews in a respectful and objective manner.
  • Not posting reviews that are false, misleading, or defamatory.

3. Content

You are responsible for all content (including text, photos, logos, and videos) that you upload or submit to the Platform (“Content”). You retain all ownership rights to your Content, but by submitting it to the Platform, you grant Thriveme a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, distribute, and translate your Content for the purpose of operating and promoting the Platform.

4. User Conduct

You agree to not:

• Use the Platform for any illegal or unauthorized purpose.
• Violate any applicable laws or regulations.
• Infringe on the intellectual property rights of others.
• Transmit any viruses or other harmful code.
• Harass, abuse, or threaten any other user.
• Impersonate any person or entity.
• Interfere with the operation of the Platform.

5. Disclaimers

The Platform and all Content are provided “as is” and without warranties of any kind, express or implied. Thriveme disclaims all warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement. Thriveme does not guarantee the accuracy, reliability, or completeness of any Content on the Platform.

6. Limitation of Liability

Thriveme will not be liable for any damages arising out of or related to your use of the Platform, including, but not limited to, direct, indirect, incidental, consequential, or punitive damages.

7. Termination

Thriveme may terminate your access to the Platform at any time and for any reason, with or without notice.

8. Intellectual Property

The Platform and all content and materials included on the Platform are the intellectual property of Thriveme or its licensors. You may not use any Thriveme trademarks, copyrights, or other intellectual property without our prior written consent.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India.

10. Dispute Resolution

Any dispute arising out of or relating to these Terms shall be settled by arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in New Delhi, India.

11. Entire Agreement

These Terms constitute the entire agreement between you and Thriveme with respect to your use of the Platform.
